Terms of Service
The agreement between you and Miami Metro LLC for using LeadCove.
1. Who we are
LeadCove is a brand owned and operated by Miami Metro LLC, a Florida limited liability company ("we," "us," "our"). You can reach us at [email protected]. References to "you" mean the individual or entity using LeadCove.
2. Acceptance
By creating an account, accessing the dashboard, or using any LeadCove API, you agree to these Terms. If you don't agree, don't use the service.
3. Eligibility and accounts
- You must be at least 18 years old.
- You represent that you are a licensed real estate professional, broker, brokerage, or otherwise authorized to engage in prospecting activities in your jurisdiction.
- You are responsible for keeping your password secret and for all activity under your account.
- One account per person. Sharing credentials with anyone outside your authorized team is prohibited.
4. The service — what LeadCove does (and doesn't)
LeadCove ingests prospect lists you upload, runs them through our processing pipeline, and surfaces information available from public records and licensed data partners — including, where matchable, owner names, the people behind LLCs and trusts, phone numbers, and email addresses. We consolidate same-owner duplicates, score, and persist the results in your private workspace.
What we do not promise:
- That every record will return a contact. Match rates vary by market, list quality, owner type, and data-partner coverage.
- That any contact information is current, correct, complete, or that the person at that number/email wants to be contacted.
- That the service will be uninterrupted or error-free.
LeadCove is provided "as is" and "as available." Use it as a tool, not as a substitute for your own judgment, due diligence, or compliance.
5. Your obligations — compliance is on you
This is the most important section. You — not LeadCove — are responsible for the legality of every call, text, and email you make using data the service surfaces. By using LeadCove, you agree to:
- Comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the Florida Telephone Solicitation Act, and any other federal, state, and local laws governing your outreach.
- Maintain and honor an internal Do Not Call (DNC) list. Scrub against the National DNC Registry where required.
- Obtain prior express written consent before sending automated marketing SMS or making robocalls.
- Honor STOP / unsubscribe / opt-out requests promptly across every channel.
- Identify yourself accurately in every outreach.
- Respect the fair-housing rules applicable to your jurisdiction.
- Not use LeadCove for harassment, fraud, deception, or any illegal purpose.
If you cause us to be involved in a TCPA, DNC, fair-housing, or similar claim because of your outreach, Section 11 (Indemnification) applies.
6. Acceptable use — what's prohibited
- Reverse-engineering, scraping, or attempting to access another customer's data.
- Reselling, redistributing, or sublicensing LeadCove data or the service itself without our prior written consent.
- Bulk-downloading the database or using LeadCove to assemble a competing dataset.
- Uploading data you do not have the legal right to process (for example, contact lists you obtained without consent).
- Anything that meaningfully degrades the service for other customers.
7. Your data and your content
You own your uploads and your work product. Lists you upload, notes you write, call outcomes you log, and exports you take with you remain yours. You grant Miami Metro LLC a non-exclusive license to process and store that content solely to provide and improve the service. We don't sell your data, ever. See the Privacy Policy for full detail.
8. Subscriptions, payment, refunds
- Subscriptions renew automatically each month or year on the same calendar day.
- You can cancel any time from the in-app billing settings; cancellation takes effect at the end of the current period.
- Fees already paid for the current period are non-refundable except where required by law.
- Add-on enrichment packs are sold prepaid and non-refundable.
- We may change pricing on 30 days' email notice.
9. Termination
You may close your account at any time. We may suspend or terminate your account immediately if you breach these Terms (especially Sections 5 or 6) or if your use creates a legal, security, or reputational risk for the service. On termination, your data is deleted within 30 days unless we have a legal duty to retain it.
10. Disclaimers
LeadCove is provided "as is," with no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We make no representation that any contact information surfaced by the service is correct, current, or that the person at that contact wants to be reached.
11. Limitation of liability
To the maximum extent permitted by law, Miami Metro LLC's total liability to you for any claim relating to LeadCove will not exceed the greater of (a) the fees you paid us in the twelve months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Neither party will be liable for any indirect, consequential, incidental, special, or punitive damages, or for lost profits, lost data, or business interruption.
12. Indemnification
You agree to defend, indemnify, and hold harmless Miami Metro LLC and its officers, members, employees, and contractors from any claim, loss, or expense (including reasonable attorneys' fees) arising out of (a) your outreach activity using the service, (b) your violation of these Terms, (c) your violation of any applicable law (including TCPA and DNC rules), or (d) data you uploaded that you didn't have the right to process.
13. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and both parties consent to that jurisdiction. Either party may seek small-claims relief in any court of competent jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be sent to your account email at least 14 days before they take effect. Continued use of LeadCove after that date means you accept the new Terms.
